Happiness Essay Most humans, I hope, strive and yearn for happiness in whatever they do. It’s almost as if it’s a basic human need. They want to â€Å"feel good,† content, and satisfied with whatever they do or have. In the Jewish Text â€Å"Ethics of Our Fathers† it is written, â€Å"Who is Rich? One who is happy with his portion. † I wholeheartedly believe this scripture. People always want more and more, yet they never seem to be contempt. They want the next best car, or the nicer shirt, but they can’t seem to achieve the happiness they so desire. Unfortunately we see often in the news of a wealthy businessman, or a famous actor/actress who are either arrested or worse, found dead because of an alcohol or drug related event. Why do these wealthy, successful and beautiful people do this to themselves? They have everything there heart desires at their fingertips, but there is something visibly lacking. I believe that it’s because they weren’t able to achieve true happiness and they fell into a bad depression. Someone can have so much money, clothes and cars, but where is the love? Where is the true human interaction? I can honestly say most of these people live artificial lives. From their â€Å"celebrity relationships† with 5 kids from 3 husbands to having every new piece of clothing, they see themselves that it’s all empty and meaningless but they can’t get out of that rut. Business men who either have the â€Å"too-much-money† syndrome or the ones that have fallen on extremely hard times have the same issue, so much as they even have a stereotype when it comes to depression- doing drugs, and lots of it. While this all seems clear cut and simple, it’s truly not. The human mind is very complex and very unique. Richard Layard, in his book â€Å"Happiness- Lessons From A New Science† tries to shed some light on this topic and even suggests some ways on how to change ourselves to become happy and to attain more and more happiness during our lives. He uses his knowledge of several different sciences and economics to try to show us where happiness comes from and how we can attain it. Layard starts off with a series of questions on page 12 â€Å"So what is the feeling of happiness? Is there a state of â€Å"feeling good† or â€Å"feeling bad† that is a dimension of all our waking life? Can people say at any moment how they feel? Indeed, is your happiness something, a bit like your temperature, that is always there, fluctuating away whether you think about it or not? If so, can I compare my happiness with yours? † Layard asked some very in depth and powerful questions here. He then proceeded to answer them all with a yes. I don’t believe that the answer is a universal yes. There are billions of people in the world with billions of different backgrounds, feelings and beliefs. One point I can agree with Layard on is his second question, Is there a state of â€Å"feeling good† or â€Å"feeling bad† that is a dimension of all our waking life? There is. When we as humans do tasks or interact with other people, we need to be in a certain mind frame. If someone, for example, isn’t in a â€Å"happy mood† they might not be able to accomplish what they would like to because their mind is in a state which won’t allow them to. When I was studying abroad in Israel I went through a traumatic, near death experience. I was jeeping with my cousins near the Jordan Desert when suddenly ground gave way to our jeep and we overturned into a deep ditch. I was on the side that the jeep landed on and was buried under debris and all of the gear and belongings that were in the jeep at the time. My oldest cousin Yossi, an ex-delta sniper for the Israeli Defense Forces, extricated me out, I was in a shaken up but happy mood. That happy mood didn’t last too long. We had to wait over 3 hours for a team of professionals to come and evacuate us out of the desert. I was getting scared and cold, all the meanwhile with much time on my hands to sit and ponder. I eventually went into a mild depression for the next few days. Little to no appetite, almost no conversation, and even skipping prayer services were some of the effects of this mini-depression. I went to Israel to study and to become more observant in my religion. The experience of the jeeping accident led me into â€Å"bad mood† that temporarily blinded me from my purpose, and what I wanted to accomplish couldn’t be accomplished at that time. When Layard talks about â€Å"The Function of Happiness† on page 24, he makes a strong statement â€Å"It (happiness) is supremely important because it is our overall motivational device. We seek to feel good and to avoid pain. (not moment by moment, but overall. )† He brings examples of things that we do in everyday life that bring us happiness or sadness, things that if they weren’t done, would have brought the human race to its demise. He brings this to light to show that even when we are not realizing it, we are looking to bring ourselves happiness and joy, and while not realizing it, we are achieving a human need of happiness. Layard, on page 48, delves into something I can honestly assume a great portion of humanity deals with. It is the concept of the â€Å"Hedonic Treadmill†; once a human gets something nice or something â€Å"happy† occurs in one’s life, the good feeling only lasts a while until that person wants more, or the next best happiness. Rich people always want the next fastest car, the watch with the most diamonds that year, the dress with the most zeros on the price tag than the year before. If one wasn’t able to acquire that â€Å"need or want† that they so desired, they would not be as happy as they were and, according to Layard, one would â€Å"revert† back to how they felt before they had that next best thing. I deal with this feeling every day, but through discussions with close mentors of mine, I have been able to curb that want somewhat, but sometimes I still can’t help it. I always wanted to lease a car with features, but I was rejected by car companies many times. Finally this year after much thought and after getting my finances in line, I was approved to lease a 2012 Honda. The car came with leather, power seats, heated seats, and alloy rims. I was ecstatic! I finally got what I have been wanting. Now it’s a month later and Im getting used to the car, but I want more features in it. I see myself â€Å"running† on this treadmill. I realize it’s a natural human want, but I try to make myself happy with what I have and I utilize mentors and friends to help me feel the way I desire to feel. Taking NLP into consideration, I see a perfect example of â€Å"mirroring† involved with the way we feel with regards to happiness and feelings. For example, at on occasion or get together, whether a happy or sad one, people usually act the way most people are at those events. When a bride or groom walks down the aisle at a wedding, one might not have the intention to clap for them, but they do anyway unintentionally because other people are doing it. Another example is when couples are married and live together for 40 to 50 years. They tend to start looking similar to each other even though they looked completely different at time of marriage. The same goes here with materialistic happiness and satisfaction. We sometimes want the next best thing because our friend does, or because our friend has it and we want to mirror them and have the same thing. While I feel that Layard makes amazing points on the topic of happiness and the way we deal with feelings on a daily basis, I don’t believe he has the final word on it. He is an independent researcher with only his opinion to back it up. The world is way too large and diverse to even base a scientific study on happiness with a range of 80,000 people. He definitely makes some headway into shedding light on the way we feel and what makes humans feel the way they do. My personal formula for happiness hasn’t changed much, but after reading some of what Layard has to say, and considering some NLP, I actually understand more why certain things make me and others happy, things that I didn’t understand previously. I now know why I feel the way I feel sometimes after purchasing an item, or going through an experience. Happiness is a very tough concept to understand but with learning and self-introspection, one can move closer to true happiness every day.

Far From the Madding Crowd by Thomas Hardy :: Thomas Hardy

Far From the Madding Crowd is considered the first great novel of Thomas Hardy. Margaret Drabble, editor and novelist, cites the novel as "the first of Thomas Hardy's great novels, and the first to sound the tragic note for which his fiction is best remembered" (Hardy xiii). Hardy was born in 1840 and began life as an architect. He wrote his first novel, The Poor Man and the Lady, in 1867. It was not received well. Four years later he wrote three more novels, two anonymously and one bearing his name; they were received slightly better then the first. His popularity and fame did not bloom until the release of his fifth novel, Far From the Madding Crowd. This novel launched him into the public eye and helped him to become the amazing writer and creator of the Wessex novels, as we know him today. The major turning point in Hardy's life was the reception of his novel, Jude the Obscure. Because of the major conflict concerning the book and it's readers, Hardy swore to never write fiction again. Approximately thirty years later, after writing some poetry and short stories, Hardy dies and is buried next to Dickens in Westminster Abbey. His heart is buried in the Wessex countryside in the parish churchyard at Stinsford. Far From the Madding Crowd is the first of Hardy's notorious Wessex novels. The main characters in the novel are Bathsheba Everdene, Gabriel Oak, Sergeant Troy and Farmer Boldwood. The novel begins with Oak and Everdene being introduced and Oak asking for Everdene's hand in marriage. She, of course, says no. After Oak's sheep are killed in a freak accident, he must venture out and look for new work and winds up on Everdene's farm in Weatherby where he becomes head shepherd. Everdene continues to flirt with Oak and also with the neighboring landowner, Boldwood, whom ends up proposing to her as well. Again, her reply is, no. Finally we are introduced to the young Sergeant Troy, who also asks for Bathsheba's hand in marriage and this time we are shocked to find out the her reply was, yes! Towards the end of the novel we find out that Troy has also seduced and impregnated a young milkmaid who has died in childbirth. Boldwood goes crazy and kills Troy because of his passion for Bathsheba and her refusal of him, and Bathsheba ends up betrothed to Oak.

Are illegal aliens a problem of immigration? A purported view is immigration is not the problem, but rather the control and enforcement of immigration. In any country, the unchecked and illicit inflow of people can pose a challenge to that country's sovereignty.Rich countries have three major concerns when it comes to immigration. First, there is the belief that it causes wage inequality by a reduction in wages for domestic worker due to competition from immigrants. Next, there is the pressure it puts on facilities like schools and services like healthcare and welfare payments. This pressure is borne by taxpayers. Finally, especially post-911, there is the concern that there could be incidences of enemies hosted in immigrant communities.Another increasing concern is the amount of money crossing borders by way of remittances to extended family. Worker remittances from the US to Mexico came up to $16.6 billion last year. This amount is second only to petroleum in the US export revenues .The financial burden that illegal immigrants put on a country cannot be underestimated. The Federation for American Immigration Reform estimated a $7.7 billion spend a year in California to educate illegal immigrants and their children. The State of California also spends yearly $1.4 billion on health care and on illegal immigrants in prison.The major reason for illegal immigration is that the supply does not meet the demand. In the US, there is provision for 675,000 visas a year for permanent residence. 480,000 of these are available for the family reunification, 140,000 are based on employment. Humanitarian visas awarded to refugees were at a maximum of 70,000 in 2004. The diversity lottery gives out another 50,000 visas to citizens of countries that have sent fewer than 50,000 migrants in the previous five years.Different countries like Spain, France and the US have varying experiences of illegal aliens.Spain has its own share of trying to control the entry of illegal aliens ont o its shores. Sub-Saharan Africa sees the neighboring country as the closest refuge. 5,000 clandestine immigrants, trying to escape the consequences of a population that far outstrips it economic capability, have crossed the border with about 1,000 drowning as the board fragile fishing boats to make their way to the Canary Islands.Since France does not have the US advantage of a flexible labor market and stingy welfare state, it has ended up with a resentful immigrant underclass with time on its hands. France today has a low proportion of skilled immigrants.The French interior minister, Nicolas Sarkozy, is working on reversing this trend. He is proposing a managed, high-skilled, demand-led immigration policy by introducing a selective immigration policy with quotas for workers, students and families and allowing entry to those who have the means to support a family.This policy would involve opening up the borders to more skilled workers while clamping down illegal aliens through a c loser watch on bogus marriages, increased deportation and scrapping the automatic right to stay after 10 years of being in France illegally.There are some 12 million illegal immigrants in the U.S., most of them employed. It is being said that tight legal controls have driven Latinos to illegality and across the U.S., 117,000 undocumented immigrants, the majority from Mexico, gather daily, looking for work.My personal experience is that illegal immigrants go after the jobs that citizens are not likely to be interested in like agriculture, landscaping, and housekeeping and most people are not averse to hiring them.

Corporation Rules and Regulations Essay

The group had been liable for 70% of Australian asbestos consumption. However, in February 2007, ASIC had started to impose civil proceedings against James Hardie, the directors and the officers, as ASIC alleged that JHIL and both executive and non-executive had breached their statutory duty. This short research report had outlined the role of ASIC and various penalty that ASIC can impose under Corporation Act 2001. Besides that, we will also discuss the position that ASIC had held from 2004 until current date in relation to the directors of Hardie group. At last, I had provided a summary of the ASIC’s media release that had been established on 13 May 2011, and indentified the element that ASIC is hoping the High Court to uphold. The Role of ASIC: The Australian Security and Investment Commission (ASIC) is a commonwealth statutory corporation that set up by Australian Securities and Investments Commission Act, and it is a regulator which in charge of monitoring the Australia’s Corporation, products, markets and financial services (Lipton, Herzberg and Welsh 2012, p. 736). On the other hand, ASIC is also a commonwealth authority that is responsible for governing the Corporation Act. ASIC Act provided that ASIC owned such powers and function that endowed by the corporation legislation to ASIC. Thus, what exactly is the corporation legislation means? Under Section 5(1), they had interpreted the term ‘corporation legislation’ to mean the ASIC Act and the Corporation Act (Baxt, Finnane and Harris 2012). Besides that, ASIC also owned the power to initiate prosecution for criminal offences or apply for civil penalty orders if they believed that there’s a contravention of the law. ASIC is also able to ban a director from managing a company for a certain period if they contravened their general duties. For instance, in the case of ASIC v Stephen William Vizard [2005], the court held that as a director of Telstra, Mr. Vizard has contravened the Corporation Act: Section 183, the duty of director to use the information in an improper purpose, and gain advantage for himself, thus, the court order pecuniary penalties and a disqualification order against Mr. Vizard (Price Waterhouse Coopers 2012). As a result of that, ASIC actually played a significant role in relation to initiate prosecution against companies directors for misconduct in order to ensure corporation and those related parties are complied with the corporation legislation. Now, let us look at the duties of a corporation’s directors under Corporation Act and what penalty can ASIC can imposed if the directors do not comply with the Corporation Act. The duties of a company’s director: The term ‘director’ is a person who is appointed to manage control or govern the affairs of a corporation. Under Section 9 definitions, the term directors extend to a person who is not formally appointed as a director, but they act as a director or whose instruction or whishes are followed customarily (Baxt, Finnane and Harris 2012). In chapter 2D. 1 of the Corporation Act, from Section 180 until Section 184, it dedicated that the principle duties of a director. They can be listed as followed: †¢Section 180 stated that a director or other officer of a corporation must exercise their power and discharge the duties in a manner with care and diligence (Mclnnes Wilson Lawyers 2011). Section 181 declared that, a director should exercise their power and discharge their duties in good faith where it’s in the best interest of the corporation and for a proper purpose (Mclnnes Wilson Lawyers 2011). †¢Section 182 stated that, a director must not improperly use their position to obtain an advantage for themselves or other or cause lesion to the company. (Armstrong Lawyers 2007). Having understood the general duties of a company’s director, we can now look at the penalties that ASIC could impose if the directors had breach their duty or do not comply with the Corporation Act 2001. The penalties: As we mentioned before, the Australian Securities and Investment (ASIC) is a national body that’s responsible to govern the corporation legislation and securities regulation in Australia. ASIC obtained the power to investigate potential contravention of the corporation law and significant penalties can be imposed on the directors who had failed to perform their duties. The section of the Corporation Act attracting civil penalties under Section 1317J (1), ASIC can apply to the court for a: †¢Ã¢â‚¬ËœDeclaration of contravention’ †¢Ã¢â‚¬ËœPecuniary penalties ‘ †¢Ã¢â‚¬ËœCompensation order’ (Baxt, Finnane and Harris 2012) 1)Pecuniary penalty order: The court may order a pecuniary penalty of up to $200,000 to a director who breaches his duty under Corporation Act. Once the declaration of a contravention by the person had been made (Section 1317E), and the contravention is a corporation penalty (Price Waterhouse Coopers 2012). (2)Compensation order: Under Section 1317H, the court may order a person to compensate the company where loss is suffered because the person had contravened a corporation civil penalty provision (Price Waterhouse Coopers 2012). (3)Disqualification from managing a company: The Corporation Act Section 206C conferred ASIC the power to disqualify the directors from managing a company for a certain periods of time due to the contravention of their general duties (Price Waterhouse Coopers 2012). This concept can be illustrated by the following case: ASIC v Vines [2006], it had been found that Mr. Vines had breached his duty of care and diligence by misleading and an inadequate disclosure of material information to the board of directors and failure to ensure the statement was incorrect. The board was relying on Mr. Vines to make complete disclosure to all material matters. The court held that, as the director had breach their duties of care and diligence b providing fault statement, thus, he had breach civil penalty provisions. The court decided that, Mr. Vines will have to receive a 3 years disqualification, pay a pecuniary penalty of $100,000 and 22% of the ASIC cost (Price Waterhouse Coopers 2012). ASIC’s position that held from 2004-2012: The position of ASIC held from 2004-2012 in relation to the directors of James Hardie case had not altered. Why would I say that? Below is the details of ASIC’s position in relation to the directors of James Hardie: On he 27th February 2004, the NSW government had authorized Mr. David Jackson to conduct a special commission of Inquiry into James Hardie newly founded foundation-Medical Research and Compensation Foundation (Australian Council of Trade Union 2007). At first instance, it had been found out that, the foundation was in fact had a nearly 1. 5 billion of shortfall, and a media release saying that the MRCF is ‘fully founded’ to meet all the current and future asbestos claims to the Australia Securities Exchange through the approval of the board directors during the directors meeting. Thus, ASIC had alleged that JHIL had made a misleading and deceptive statement. As a result of that, it had raised a principle issue for the board of directors of JHIL, whether or not they had knowingly voted in favor of releasing the ‘misleading’ announcement to ASX (Alcorn 2011). In addition, the sub issues that had been raised are under Section 180(1), was a general counsel can be treated as an officer? The Original Decision: In April 2009, ASIC held that all of the executive, non-executive and company officer had breached their duty of care by approving the media statement to be made in ASX. In particularly, ASIC had alleged that, the company chief executive officer and company secretary or general counsel, Mr. Macdonald and Mr. Shafron had breached the director’s duty of care and diligence under Section 180(1) as they had failed to advice the board to disclose the DOCI information to ASX (Hargovan 2009). Thus the court had imposed penalties on both of them: †¢Mr. Macdonald was disqualified from managing a company for 15 years and a pecuniary penalty of $350,000. According to the Corporation Act 2001, Section 180(1), an officer obtain the power in decision making which affected the whole or substantial part of a business, thus, Mr, Shafron had a positive obligation to advise the board of the disclosure of DOCI. In relation, he was given a disqualification order for 7 years and a pecuniary penalty of $75,000 (Baxt, Finnane and Harris 2012). †¢Mr. Morley had been banned from the management for 5 years and paid a pecuniary penalty of $35,000. †¢However, all of the seven former non-executives directors were disqualified from management for 5 years each and a pecuniary penalty of $30,000. The Appeal: In December 2010, the NSW court of Appeal overturned the finding in relation to liabilities and penalties of the non-executives directors, the CFO and secretary general counsel of James Hardie Industries Ltd as ASIC had failed to prove that the ASX media statement was approved by the board, and as the appellate court had established that some of the directors had acted honestly without any intention to gain benefit from themselves, which is under Section 1317 of the Corporation Act 2001 (Hargovan 2011). Thus, amendment had been made in relation to lessen the liabilities and penalty of the directors and officer can be found in later section (summary of media release). Nevertheless, it’s worth noting that Mr. Shafron, Mr. Morley and ASIC had filled application for special leave to appeal the decision of the Court of Appeal. Art History 5 December 2000 Frank Lloyd Wright American architect, Frank Lloyd Wright is considered the pioneer in modern style and one of the greatest figures in twentieth-century architecture (Twombly, 16). According to Frank Lloyd Wright: having a good start, not only do I fully intend to be the greatest architect who has yet lived, but fully intend to be the greatest architect who will ever live. Yes, I intend to be the greatest architect of all time. It appears that from the beginning, Frank Lloyd Wright was destined by fate, or determination, or by his mothers support, to be one of the most innovative and celebrated architects of the twentieth century. Throughout his life, he designed nearly 900 structures, some 400 of which were actually built. He was principally known for his highly original methods of uniting buildings with their surroundings (Hirsh, 189). Wright was also renowned for initiating new architectural and engineering techniques but was often criticized by the more conventional architects who opposed his new methods (Twombly, 17 - 18). Frank Lincoln Wright (he would later change his middle name to Lloyd) was born on June 8 1867 in Richland Center, Wisconsin, to Anna Lloyd-Jones Wright and William Russell Cary Wright. Anna Lloyd-Jones was a teacher from a large close-knit Welsh family of farmers and ministers. His mother and her family would have a tremendous influence on Frank throughout his life. Franks father, William, was a devout Unitarian preacher and musician. The Wright family spent many evenings listening to William read such works as Emerson, Thoreau, and Blake . In 1869 through 1878, the Wright family traveled the country, relocating to Iowa, Rhode Island, and Massachusetts, where William held pastorate positions (Taliesin Preservation). His father moved from job to job dragging the family along which often resulted in financial difficulties. In 1878, the Wrights eventually returned to the hills of Wisconsin, close to the strong support of Annas family. Finally, settling back in Wisconsin, William Wright became secretary of the Wisconsin Conference of Unitarians and Independent Societies (Gill, 57). Anna relied heavily upon her family to help rear her children. Frank spent numerous hours helping his uncles in the fields, who taught him the importance of hard work. His aunts and his mother intellectually guided him in education, religion, and nature, which played an important part in forming Franks architectural philosophy. Using Froebels geometric blocks to entertain and educate her son, Anna seems to have struck on the genius and imagination her son possessed. Anna consistently encouraged Frank to achieve great things in the field of Architecture (Gill, 58). In 1885, Frank quit high school and entered the University of Wisconsin at Madison (as a special student). He studied civil engineering because the school did not offer any courses in architecture. The parents, victims and other bystanders have the responsibility to report the incident to the police. Legal action can also be carried out if the other methods that have been used to intervene by the parents and the teachers have failed. It is also encouraged when there is a possibility that the bullying will reduce once the case is reported. When the bullying also takes place outside the school compound, the parents and teachers together with the community can cooperate with the police to prevent and stop it. Parents normally take up this view since the occurrence of bullying is so common hence it looks like a normal thing to occur to children when they are in school. The truth of the matter is that the aggression that is both physical and emotional should not be taken to be a normal part of childhood and action should be taken against it. They hold the opinions that the more that the children are bullied the more they are able to toughen up and become strong emotionally and physically. Gasoline has positively influenced our way of life by providing convenient, on demand transportation. The tremendous political, environmental, and economic problems resultant from the excessive use of gasoline leads to the conclusion that the automobile industry should not continue to rely on this source of fuel. Environmental Risks When the problems with gasoline use are considered, the catastrophic environmental effects are the primary concern. Automobile use consumes 70 percent of the United States oil supply and is responsible for one-third of the nation’s carbon emissions (Lovins 173). This results in pollution, global warming, and health problems for the people, plants, and animals. The search for alternative fuel is powered by the increasingly evident environmental problems and long-term health of the planet (Povey 17). Fortunately, reducing emissions globally is predicted to have a positive effect and offset previous harms (Backer). As years pass and demand for gasoline increases, it is inevitable that the world’s oil supply will not last forever. This idea is made increasingly clear by evidence of peaking. Finding an alternative fuel would be much safer, and much less expensive. Alternative fuels also do not fund a war against America. Alternative fuels allow America to keep to themselves and avoid conflict. Gasoline is thought to be a helpful substance to all countries worldwide. However, the negative effects are far greater than the positive. A diversity of clean fuels is vital for the political, environmental, and economic health of America. Although gasoline is a product depended on by the United States of America and many other countries, the negative effects are unbearable, dangerous, and unnecessary due to the opportunity to use alternative fuels.

Question: Do males and females have different abilities when estimating size? Abstract This science research the different abilities in reckon sizes between males and females. And the research was taken from an experiment with 20 Chinese teenagers between 15 and 18. The hypothesis was males’ abilities when estimating sizes is better than females†¦. Introduction As we all know, males and females are different in many abilities, and this research for testing difference between males and females estimating size.And this ability also is affected by the cultivation from the child, their brain have different talent. The hypothesis was those males’ abilities when estimating size is better than females’ abilities. Research Methodology In this experiment, there had 10 males’ and 10 females’ age from 15 to 17 as experiment objects. Firstly, a textbook (width: 20. 7cm), a MP3 (length: 8cm) and an ID card (width: 5. 4cm) were measured by a ruler. In each s ubject, everyone stood one meter away from me, and then they could observe each one for 10 seconds.After that, they should tell me their estimation. Finally, the data was collected into the table to comparison and prove the assumption. Research Results The results were inconsistent with my previous hypothesis; females can estimate stuff more accurate than males. The raw data of males’ and females’ measuring results of textbook, MP3 and ID card were cleared up to Appendix 1 and Appendix 2. The table below shows that the experimental results of different gender of teenagers from 15 to 18 have different estimated capacity.As we can see clearly from the mean about textbook, males was 20. 24cm and females was 18. 4cm, which shows males had 0. 46cm of the deviation and females had 2. 3cm of the deviation. Probation is a type of sentence for criminal defendants. Probation allows a convicted defendant to go free with a suspended sentence for a specified duration during good behavior. Probationers are placed under the supervision of a probation officer and must fulfill certain conditions. If the probationer violates a condition of probation, the court may place additional restrictions on the probationer or order the probationer to serve a term of imprisonment. Intensive probationers are required to report daily to a probation officer and most times has an electronic monitoring system or they are on house arrest. Certain violent criminals and repeat offenders are not eligible for probation according to the statutory restrictions most states use to determine eligibility. Offenders placed on probation are subject to required conditions. There are standard conditions which all probationers have. Standard conditions include reporting to the probation office, reporting change of address, being employed, and not leaving the jurisdiction without permission. Punitive conditions are set to reflect the seriousness of the offense and make probation a little more painful. Examples of punitive conditions are fines, community service, victim restitution, house arrest, and drug testing. At yearend 2002, 1,440,655 prisoners were under the jurisdiction of State or Federal correctional authorities. Looking at the Re entry trend it st ates at least 95% of all State prisoners will be released from prison at some point; nearly 80% will be released to parole supervision. In 2001, about 592,000 State prison inmates were released to the community after serving time in prison. All of this information is significant because it keeps a close eye on how many prisoners are released on probation and what percent of these prisoners did not follow through with it. According to the information from BJS it shows that probation effectiveness has its good times and its bad times. I think that probation is an effective form of community corrections as it can be. There is never a 100% effective way of stopping people from committing crime. If someone commits a crime even knowing the consequences, chances are they will do it again with or without probation. I think the government needs to focus on why people are committing crime and try to prevent crime before it happens. I also think that maybe there needs to be longer probation periods and harsher ones for repeat offenders. I also think that probation should be for less serious crimes and maybe for misdemeanors and not felonies.

In this light we see that Conrads book was way ahead of its time, exploring racism and both physical and mental journeys into the congo and into ones self. I believe it could be said that Conrad was not racist even if there is an inkling of racist assertions in Heart of darkness because this racist view was accepted at the time, this can be said of his usage of the word nigger in his novel (one of his earlier novels even had the word nigger in its title the nigger and the narcissus 1897) but as this was regularly used at the time it can be wavered as it didnt have the effect it does in todays society when spoken. Apart from this I think it is clear that Joseph Conrad did not conform in a racist society and had seen the horror and pure incorrectness of colonialism first hand. I have shown that Conrad and Marlow are one and the same and have been led to the conclusion through close reading of the opening of heart of darkness that Conrad is not, as Chinua Achebe states, a bloody racist. In fact I believe the opposite statemen could be made Conrad was a minority voice speaking out against racism through his character Marlow in a time where racism was rife. Some organizations however have both the HR specialists and the managers who work together by bringing in expertise from their own areas. In conclusion, the report identifies that adequate training and expert knowledge support must be provided to managers if they are expected to integrate HR responsibilities within their managerial function. Human Resource Management (HRM) refers to a collection of policies used to organise work in the employment relationship and centres on the management of work and the management of people who undertake this work (Claydon 2010). (Storey, 2007) states that HRM plays a pivotal role in strategically deploying highly capable and committed workforce by using human resources expertise to achieve competitive advantage. A strategic approach to managing employment relations which emphasizes that leveraging peoples capabilities is critical to achieving sustainable competitive advantage, this being achieved through a distinctive set of integrated employment policies, programmes and practices. (Gold 2007) Human Resource Management ensures the productive use of people in an organisation to achieve the organisations strategic business objectives. Human resource management also involves maintaining a healthy employer-employee relationship and the satisfaction of the individual employer needs (Stone 2007) Human resource policies and the business policies have been integrated together with the management function rather than a separate entity to achieve the organisations objectives more efficiently. Discussion of the context (Wilkinson M. M., 2002), states that many criticisms concerning the lack of contribution by HR specialists to organisational performance have come from line managers. The four main criticisms are first, personnel practitioners are regarded as out of touch of commercial realities and unable to comprehend much about the nature of the business, its customers, or its corporate goals. The allegation is that HR professionals base their decisions upon a set of principles and ideas, such as welfare and employee rights which have little relevance for competitive prospects. Second, HR is often thought to constrain the autonomy of managers to make decisions that they feel are in the best interest of the business. These are mainly the legal constraints of equal opportunities or individual rights and the involvement of union representatives. The third criticism is that HR managers are slow to act, always wanting to check the options thoroughly (Cunningham and Hayman, (1999). Finally HR practition ers are criticised for promulgating policies that may be fine in theory but hard to put in effect or unsuitable to their particular requirements. Legge (1995) argues that HRM is caught in a vicious circle because senior management do not involve them in the business decision making and planning as people issues are not considered at this stage of decision making. But in due course problems arise due to non involvement of HR such as poor recruits, inadequate training of staff or work disruption. When such problems are brought to HRs attention they have insufficient time to resolve the issue which in effect results in short term solutions with detrimental long term effects. HR function gets the blame for inefficient problem handling and continues to be excluded from decision making, thus completing the vicious circle. As line managers work closely with the people they manage, the problem solving can be immediate and relevant rather than having to wait for the HR department to get back to them. The solutions provided by these managers are also likely to be in congruence with the organisations goals and business requirements. Ulrich (1998) hence recommended that HR should be reconfigured so as to highlight what it delivers rather than what it does. The four recommendations for HR are, to become a partner with business and line managers for strategy formulation, to become an expert in the way work is organised and executed to reduce cost and to increase efficiency, to become a champion for employees by acting as a medium between the employees and the senior management to increase employee contribution and finally to become an agent of continuous transformation by shaping processes for successful implementation of change. The CIPD research on employee well-being and the psychological contract (Guest and Conway, 2005) established that too many managers are failing to motivate and improve the performance of people they manage. Due to the devolution of HR function to managers, their responsibilities have increased and their role in the organization has become more important. HR initiates policies and practices but it is the management which is responsible for implementing them. HR proposes but the line disposes (Armstrong 2006). It is hence important that the policies are well communicated to the manager who will implement it if it is perceived to be in the interest of the business. If managers are unaware of any laws requiring the implementation of those policies then it is up to the HR to educate the managers about this. (J.Purcell 2003) noted that well conceived HR policies and practices didnt automatically result in organisational performance improvement but the difference was made by the way in which those polices were implemented by the managers. If they used discretion in implementing HR policies then some policies will just be a set of useless ideas (Armstrong 2006) (H.H.Larsen 2003), pointed out the five main reasons why organisations want to integrate these functions; Pressure on firm costs to integrate HR function in line management role To provide a more comprehensive HRM which is achieved through this integration of line management and HR functions The growing influence of service industries where line managers are responsible for customer management HR specialists may take too long to resolve HR issues Devolution may be considered as an alternative to outsourcing the entire HR function resulting from changes in philosophy and organisational structure. Enablers for integrating management and HR functions Managers play an important role in implementing the HR policies (Gold 2007). Research has revealed that line manager behaviour has a significant impact on employee commitment, which in turn has an impact on customer commitment, which has an impact on business performance (Lazenby quoted in Purcell 2003). The enrichment of line manager roles within the organisations and their greater involvement in HR decision-making has arisen due to the increase in customer service demands and the resulting time pressure in decision making. Increasing performance requirements, transparency, flexibility and accountability has increased the importance of this dual role. Involving line mangers in HR functions can be seen as a strategic approach to managing people. (Renwick 2003), has listed the main benefits that organisations can derive from such integration; HR problems are solved at source saving vital organisation resources Better change management is achieved through manager participation in policy implementation Closely working managers can make decisions at increased speed Greater scope for HR managers to focus on strategic importance of HRM HR issues get a business focus before they are implemented hence those policies will no more be created in isolation from organisational goals Since managers are aware of HR issues they cant ignore them hence leading to a better employee manager relationship Managers are more likely to be committed to their own HR decisions rather than having to implement due to compulsion from HR department Promotes local management accountability and responsibility for HR issues Reduces costs due to integration of functions Promotes the case that HRM cant always be transferred to specialists Line managers occupy an important position in the organizational hierarchy and they can directly affect the level of service delivered. Entrusting line managers with HR responsibilities will add to their existing pressures, increase workload and the need to deliver on short-term priorities. Formal administrative approaches within the departments would require line managers to display a high level of HR competence. This signifies the need for high-quality training programs for line managers to ensure that they feel confident in discharging their new HR responsibilities. Money invested in training management personnel can result in saving company from expensive litigation and in maintaining a god corporate reputation. Providing line managers with such training is very important as they are not naturally trained to deliver HR duties, which are quite different to making business decisions. Inhibitors for integrating management and HR functions (Renwick 2003), has given the following inhibitors to HR and management integration; Increased pressure to train and/or re-skill managers in HRM A need for strict HR auditing Problems and maintaining consistency in decision making Risk of falling standards or abuse of position through discrimination Problems in maintaining balance of power between management and HR specialists Potential for the HR/ER management role to be marginalised Low line capability/commitment when doing HR work Little time for managers to perform HR duties well due to operational demands on them Risks of job overload/stress as manager workloads are increased Harrison (2009) supports the argument in favour of management staff by saying that, line management is mostly faced with situations pressurising them to achieve objectives resulting in the increase in profitability or in the reduction of costs resulting in less dedication to support human resource development apart from the basic tasks. If line managers are faced with a decision to prioritize between making a key business decision or to formulate policies and procedures to improve the working conditions of employees, the priority would normally be the business decision as that would be considered as their primary responsibility and also more business focussed. Brewster and Soderstrom (1994) say that before delegating tasks or entrusting people with more responsibility in different areas, it must consider the level of knowledge possessed by the individual and the willingness of such individual to train to learn new competences, since they could already be overburdened with their current tasks making it uncomfortable for them to absorb more responsibilities. In order for the line managers to deliver their HR tasks they need to maintain a good relationship with HR specialists which could be complex at times. According to (Thomas N Garavan 2006) while the line manager is a key stakeholder in the training and development process, their relationship with the function and/or the specialist can often be negative. This could result in issues arising from lack of good communication and understanding between the departments. According to Grace and Straub (1991) training specialists often exclude line managers from training the reason for which is mainly the threat of being substituted. Some such instances as noticed by them are; Excluding line managers from the needs assessment process/program; Unwillingness to consider line managers as subject matter experts; Unwillingness to utilize line managers as instructors for training duties. This could also be due to the resistance on part of the line mangers to take initiative to train as this could entail more responsibilities for them. As (Thomas N Garavan 2006) continues the argument by saying that the issue is due to the lack of trust between the line managers and the training and development specialists. Line managers refuse to co-operate with the training specialists who makes an attempt to offer advice to improve work operations because they consider training specialists as staff as providing a service in accordance with line manager requirements and expectations. Efforts to change this role are often perceived by the line managers as an attempt to thwart line authority with the generation of better ideas. Sometimes HR professionals were even seen as policing line managers. This perception leads to inflexibility and negative responses aimed at demolishing the strengths and foundations of the training specialist. Also Storey (1992) points out that lack of training and education of line managers hinder the smooth delivery of new HR practices. Those line managers simply underestimate the need for investment in the training of their subordinates. Developing and implementing HR initiatives can become a difficult task for the managers to incorporate in their regular management function. Suggestions to improve managers as people managers (J.Purcell 2003), have suggested that managers can improve their people management skills, to deliver their HR responsibilities, in following ways; Senior management must understand the prioritisation issues that managers may face when both management and HR issues arise at the same time. Pressurising from the top will not help in such circumstances Managers must be selected considering the behavioural requirements and competencies expected from them as they would be doing HR function as well Managers need to have a clear understanding of the organisational values, goals and culture for efficient people management. A good working relationship needs to exist between staff and their manager Managers must be provided with the necessary training to enable them to deliver their HR functions such as performance management, grievance and complaints handling Although line managers can be trained to an extent to carry out the HR function, there are several key competencies possessed by HR professionals that might be difficult to incorporate in a line manager function as per (Armstrong 2006). There has been a significant change to the way in which organisations manage their business in the recent years and hence there has been changes in the way different departments operates within it. Changes to work demands have made it difficult for the HR department to find people with required talents for the organisation. HR department is required to keep up to date with the HR requirement of the departments and ensures the human resource is able to meet new challenges and demands (Wright, 2003) A human resource manager must consider the nature of external and internal influences before selecting a particular course of action. Internal environmental influences involve the factors that are found within the organisation such as the organisational strategies, organisational culture, organisational structure and organisational systems. Several external factors influence the formulation and requirements of HRM policies. Some of the external factors facing organisations are changing nature work force, technological changes, globalisation and labour force demographics. (Stone 2007) CIPD has presented a list of core functions delivered by HR professionals as below; Business and cultural awareness: understand the business environment and the competitive pressures in the market facing the organisation, the key business activities, culture and the impact of HR policies on the business performance Strategic capability: seeks involvement in business strategy function, develops coherent HR strategies which are aligned with business strategy, understand the importance of human capital measurement to ensure efficient utilisation Organisational effectiveness: contributes to the analysis of people issues and proposes practical solutions, develops resource capability by ensuring that the organisation has the workforce with required skills, process redesigning for better utilisation of staff, contributes in the development of knowledge management processes Internal consultancy: proposes practical solutions by providing expert advice and coaches management on dealing with their department specific problems Service delivery: delivers appropriate services promptly and efficiently to requests for HR services and advice and provides guidance in HR decisions as required Continuous professional development: continuous development of skills and knowledge, to deliver the HR duties to high standards by updating the new HR concepts, practices and techniques As discussed above HR function is far more specialised in its core activities and many of its functions need specialist expert knowledge which is difficult for management to keep up to date with. HR Outsourcing has become more common in the recent years as the companies are relying on them for HR related matters. A good human resource outsourcing deal is to ensure that nearly all your transactional and basic advisory services are outsourced and that the jobs of the HR teams are redesigned so that they no longer focus on the operational level decisions but the focus would be on more complex business challenges and strategic needs. (Hunter 2007). But many organisations may choose to rather incorporate the HR function within their management functions rather than outsourcing. Conclusion HR can be seen as an integral part of a managerial post, as a manager is responsible for the performance and job satisfaction of his staff. There have been several factors over a period of time that has had an impact on the role of HR managers and practitioners. If an employee in a management positions accepts to deliver HR duties it is possible to achieve a higher level of efficiency. However, the success of any change process involving line manager HR participation will ultimately depend on striking a balance between factors favouring devolvement and those inhibiting HR involvement. While making line managers more responsible for HR may bring about a speedier resolution to workplace conflicts, clear structures need to be implemented to allow line managers seek guidance and advice, but also allow employees to repeal decisions made. In this regard, HR specialists need to proactively engage with line managers and bring about partnership HR approaches to managing employees. There are however certain boundaries to such a devolution. All of them lie either in line managers lack of specific knowledge and expertise or in their conflict with HR specialists. As devolution of HR responsibilities are taken for granted it is suggested that it is HR specialists who need to re-consider their role within organisations, while line managers are to be given an appropriate training.
